What is this PBO thing people keep talking about?

A PBO or “pre-birth parentage order” is a court-issued document that recognizes the legal parental rights of you, the intended parents, to your child! Without this document, the law assumes that the woman giving birth to your child is the legal parent, even though she is not genetically related to the child and has no intention to be the child’s parent. Some states do not allow for PBOs and the parents have to adopt their own child after the birth – and the surrogate might be able to change her mind and try to keep your baby! Scary!

Fortunately, in New Mexico, the courts have been happy to grant PBOs to clarify who the legal parents are of a baby before the baby is born. And the New Mexico courts grants these orders to same-sex parents, allowing either two fathers on a birth certificate or two mothers on the birth certificate. Yay, equality!
